Sharīʿah in the Modern World: Addressing Misconceptions and Critiques | The Evident

The Muslim community has its own laws and regulations called Sharīʿah. Not only Muslims, but every community possesses its own rules and regulations; however, liberals critically confront Islamic laws to undermine the Islamic community.

In fact, Islamic law is one without any loopholes; spiritually, it can be considered divine. However, liberals attempt to critically analyze it. Critical analysis is not inherently problematic, but it should also consider the law's essence. Liberalism argues against women's rights in Islam, ḥadd punishments, and some rules of warfare. Many of the critics fail to understand, however, that Islamic law is not fixed or arbitrary; it is adaptable and based on moral values that are meant to protect human dignity and social peace. Accordingly, the rules are understood as relating to the individual subject to the rules and the community, so the rules balance the autonomy of the individual with responsibilities to the community by enabling justice to be achieved without transgression against those involved in the adjudication of justice. Moreover, when the reasons for the laws start to become evident, the critiques appear to miss the nuance and justice that exist, which are deflected away when considered in a superficial critique.

Literally, Islamic Sharīʿah safeguards a girl like a princess and a woman like a queen. Only Islamic law provides women with specific inheritance rights. The wearing of the ḥijāb and niqāb is for their own protection. For example, a sweet not properly covered will be eaten by ants; if it were covered properly, it would remain safe. Similarly, in Islam, a woman is primarily for her husband, and her beauty is reserved for him. These rules are not about restriction but about creating a safe and respectful environment for women. Islam recognizes the value of women and ensures their rights, dignity, and honor are maintained in every aspect of life. Beyond personal protection, these guidelines foster respect, strengthen families, and encourage a culture where moral responsibility and care for others are deeply embedded in society.

Fundamentally, Islam has established comprehensive laws for crimes. Even Gandhiji was impressed by Islamic criminal laws. They cannot be implemented simplistically. Islam has stipulated numerous conditions that ensure optimal justice. For instance, Islam requires witnesses against an accused person for the execution of a punishment – a witness who is a reputable individual in the community, one who has never lied. This ensures that the execution is legitimately warranted. This is only one example. Islamic Sharīʿah addresses every minute detail connected to victims and witnesses.

Similarly, Islam provides the most equitable laws for warfare. Islam has never encouraged initiating war, yet there are stringent regulations during conflict; trees, women, and children must be protected – a thoroughly just and fair rule.

In conclusion, Islam does not intend to constrain people under its rules and regulations; instead, Islamic law provides clear and systematic guidance. Islamic law outlines the actions to be taken in every circumstance. Understanding and critically evaluating an idea is commendable, but criticisms without comprehension are counterproductive.
